What is the statue of limitation if a family member solicit funds to be used to help bury a family member, but they don't use it for that purpose?

This could constitute a fraud charge. You would need to file a police report so they could forward it to the prosecutor's office to see if charges should be filed. The statute of limitations is six years from the date of the offense or six years from the date you found out or should have found out it was a scam. You could also sue them in small claims court or in civil court, which has a lower standard of proof so you would be more likely to get a judgement.

Can I get charged with theft?

You could be, yes. Anyone can be charged with anything. That doesn't mean you will be convicted or that they can prove your guilt beyond a reasonable doubt. That is another matter entirely. Do not speak to the police or agree to take any polygraphs without first consulting with a lawyer. Be proactive and consult with a lawyer now. Do not wait until you are charged.

I would have to review the details and your record. Domestic violence is a major issue in Michigan and under federal law.
