In order to be convicted of Theft they have to be able to prove you had the intent to deprive them of the property. Given the facts you've laid out, what they would have to prove is that you were aware that your cousin was putting stuff in the car seat, with no intention of paying for it. If you paid for the items you picked out, and walked past the pay register with his items still hidden in the car seat, it's going to be a tough case. But, if you had no idea he had stuff hidden in there that he didn't intend to pay for, you may be able to get an acquittal.

Absolutely. The police can always ask any person any question. The issue is whether the person is the person is in custody, and if so, have the police given the person their Miranda rights. If they have then there is absolutely no question they can ask whatever they want. Moreover, if a person is in custody for X and invokes her right to remain silent about X then later the police attempt to interrogate her about Y, they have not violated the law. Ridiculous, but that is the state of the law at this time in Texas. A person can always refuse to answer ANY question given to them by police except in some circumstances they must identify themselves.

Trying to get a record expunged. I had a deferred adjunication back in 2000 and was trying to get it expunged

You won't be able to get that case expunged, since it was only dismissed after successful completion of deferred probation. What you need to be looking in to is whether you can get the offense sealed. The vehicle to accomplish that is called a Petition for Non-Disclosure. You'll want to speak to an attorney before proceeding, in my opinion. First, you need to discuss with the attorney who it is you are trying to prevent from seeing the arrest records, and whether a sealing order will accomplish that goal. Second, you need to find out whether your specific offense is subject to a limitations period or whether eligible, at all.
