They don't need the weapon ... they need your wife's testimony and if she is believed you will be found guilty ... the sentence will be up to the judge.

I don't understand how this person can be convicted of murder if there was no murder. If he were convicted of murder, he would get a whole lot more prison time than 3 years. Based upon your explanation, it appears to me that you may not have all the facts accurate. I would need to review the facts of the case, including trial transcripts. If you think there is an appealable issue, I suggest you retain the services of an attorney to help you through this process.
