How to appeal a plea bargin if you were scared into taking the deal?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
It is doubtful that he can appeal. But, he may be able to pursue a writ of habeas corpus. Make sure he doesn't try to file one on his own, though. I see inmate writs all the time. Often, they are able to identify and articulate valid legal arguments. However, they do not understand procedure and, most important, how to create a record upon which to base the argument. Writs are a one-shot deal. If he files one on his own and loses (becuase of procedural default) he will not have another opportunity to file the writ, even with the help of an attorney.

What are the consequences for a violation of misdemeanor probation?

Mark Corwin Bruce
Answered by attorney Mark Corwin Bruce (Unclaimed Profile)
Criminal Law lawyer at Law Office M. C. Bruce
Yes, even dismissed charges can be the basis for a probation violation because the standard of proof on a violation is more probable than not; the standard on a case that goes to a jury is beyond a reasonable doubt. Much of whether she gets more jail time depends on the county she's in and the judge she's in front of. This is not something she should handle on her own. She needs a lawyer-either a private one or a public defender.

How do I find a pro Bono attorney in the porter Texas area.

Answered by attorney Tristan Nicolas Legrande
Criminal Law lawyer at LeGrande Law
If you are indigent, you already have a "pro bono" attorney - your appointed lawyer. If you don't have the financial resources to hire private counsel, you have a constitutional right to have a licensed attorney appointed to represent you FREE of charge.    Some appointed attorneys are highly qualified and skilled lawyers. But, if you can't afford a lawyer you do not have the right to CHOOSE your appointed attorney. The Court chooses, and if you are not satisfied with the appointed lawyer, your only option is to hire someone. If you want to choose what lawyer represents you you have to pay for that. Do not expect to find a private attorney to represent you on a drug case for free. It is not going to happen.    Good luck.
