Hello. im a screenwriter and want to know if a bailiff only stands beside the defendants seat if the defendant is in custody and not out on bond

Hi, There really is no hard and fast rule on this. They stand where they want to stand. Considering how outnumbered the Defendant is, it would be tough for him/her to make any successful escape with a bailiff at the door and three in the court. I've seen them hover, and I've seen them ignore the D completely. Completely up to them and what they feel comfortable with. During the actual trial, most defense attorney's request the court officer's not stand near the defendant as it makes them "look" guilty and is prejudicial to the defendant.  Hope this helped! No. Any applicable statute of limitations would be as to the potential underlying charge. Whether or not evidence is admissible ultimately rests upon how it was obtained, chain of custody, etc.

There is no easy answer to your question. Restitution may be involved. You should also be thinking about ending up with a felony conviction. I suggest you retain counsel.
