Can arson charges be dismissed if the arrest procedure wasn't legal?

Answered by attorney Steven Fairlie
Criminal Law lawyer at Fairlie & Lippy, P.C.
You should talk with a lawyer to be sure about what was or was not legal. The fact that your son refused to answer questions makes the failure to Mirandize him moot.

How to get my gun ownership rights restored?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
You probably can't. If you were involuntarily committed to a mental facility and/or held for more than 72 hours, you became a prohibited person barred for life under federal and CA state law from possessing guns or ammunition. No restoration is possible. If the commitment was voluntary and less than 72 hours, it MAY be possible to correct the facility records and then the DOJ / FBI records, which would then possibly allow ownership.

Should I get a lawyer for my son if the officer is looking for him?

Any person accused of a crime has the right to an attorney. Generally, getting an attorney involved early in the process is better than waiting. An attorney can advise your son on what course of action he should take to protect his rights.
