Sounds like another scam to me. You may have no recourse. I doubt that he even still has the money. You can sue him, but where does that get you an uncollectable judgment.

Unless you filed a motion to expunge and had it granted, likely the prosecution will be able to view prior files etc. It may even be evidence in the case against you. A good lawyer can counter-act this or even prevent it from coming in court lets discuss representation.
