Even if the State does not allege that the assault involved a family member, they can later prove it up if you were subsequently charged (and enhance the case to a felony.) The "family" part of the charge is generally not even discussed in negotiations - either it involves a family member or it does not. If you did not hit the person, set the case for trial! You should not plead guilty to something that you did not do and risk a future felony charge.

Sounds like you have to jump through their crazy hoops. Usually the person you bail out just gives it to you if they haven't paid you back already.

Can Texas DPS wait as long as they want to suspend your license after a conviction or do they have a time frame?

Sounds like the administrative suspension proceeding was delayed about a year for whatever reason. The judge gave you good advice. Talk to a competent driver's license lawyer right away. Do not represent yourself. Depending on when your first DWI was, you may already be suspended by the DWI judge (not the administrative judge, yet) due to the second DWI plea. Check with DPS or call us to research the current status of your license.
