That will depend on the judge. If you can pay the one you are in better shape than coming to the court with nothing. Based on my experience you should not be jailed.

Hi, Usually all statements lawfully taken during the arrest can come in. However, the person being on drugs at the time can be taken into account when/if the statements are read to the jury. But it is very likely that there will be a hearing in front of judge to determine if (i) the accused was competent enough to consent to giving a statement and, if so (ii) whether it should be allowed in at trial and (iii) if allowed in, whether it should be stipulated on the record that it is allowed in on condition that the accused sobriety or lack thereof, be mentioned prior to the statement being read or played for the jury.
