How long does the state have to try a criminal case?

That varies from cases to case. There is a constitutional and statutory right to a speedy trial. However, defendants often enter time waivers so that they don't rush into trial. Additionally, the court can continue a case beyond the speedy trial time frame, even without a time waiver, if either party makes a showing of "good cause". Some cases resolve quickly and some go on for years. Generally, serious offenses take longer to litigate.

Do you have to be read your rights when you are arrested?

Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.

Sounds like you have done all that you can do. The only option you have left is to contact the state bar association and file a complaint. It sounds like he may be dealing with some heavy issues of his own, but that does not mean you lose your money and your attorney.
