Is this a case of racial profiling?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
If you feel you are being improperly profiled by your local police or sheriff's department, or by any individual officer(s), file a complaint with the police or sheriff's department - as to the department, and as to any individual officer(s). Get their names and badge numbers. The police department will do almost anything to talk you out of doing this, but if citizens do not file complaints the cops will continue to do this unfettered, and will do as much as they can get away with. It must be documented, so don't let them talk you out filing a written complaint. Keep a copy for yourself. You might get some repercussions - such a more stops - but each time it occurs, file a complaint. If you need to, contact an attorney who can discuss other options with you.

Can I have a firearm while on probation?

default-avatar
Answered by attorney Shawn Patrick Hooks (Unclaimed Profile)
Criminal Law lawyer at Deal & Hooks, LLC
It is highly unlikely that the terms of your probation would allow you to own or possess a firearm. The court, when sentencing you to probation, most likely listed what your conditions were. One of them was probably a condition stating you could not own a firearm. If you are on probation for an offense of violence it is almost certain you cannot have one. You should contact your attorney or your probation officer to determine whether that is a condition of your probation or not.

If on probation for pc 487 then charged with possession of weed for the intent sale what exactly are they facing?

At the very least, you have a probation violation and the new charges of possession with intent to sell. You could be looking at some serious jail time, depending the facts of both cases.
