What is the average consequence for a minor who gets Possession in a Vehicle?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
There is no such thing as average. Every case and every defendant and every DA's attitude is different. Every crime carries potential jail upon conviction. The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. When charged with any crime, the proper questions are, can any evidence obtained in a test, search or statement be used against you, can you be convicted, and what can you do? While this isn't a 'capital case', it carries potential jail, so handle it right. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate. As a first time offender, your attorney may be able to get you into a diversion program or deferred entry of judgment deal, that will keep a full conviction off your record.

Can they drug test me in court if I just go to pay fines and I’m already sentenced with what I have?

Criminal Law lawyer at Musilli Brennan Associates, PLLC
It depends on the terms of your sentence. If you are subject to random drug tests, yes they can test at any time.

What are the consequences of having a BAC of .18 in Los Angeles?

default-avatar
Answered by attorney George Martin Derieg (Unclaimed Profile)
Criminal Law lawyer at The Derieg Law Firm
Having a .18 could qualify you for a longer DUI school for your first offense, depending on the DA. The minimum you are looking at is 2 days county jail, a fine, 3,6, or 9 month DUI school, probation usually at least 3 years, and other conditions of probation, like no driving with any measurable amount of alcohol is in your system. A private attorney can set up a DMV hearing to contest your detention, to allow you to keep your temporary driver's license until after the results of the hearing. A private attorney can have your chemical test re-tested faster than a public defender. A private attorney usually has a smaller caseload than a public defender and will be able to spend more time preparing your case and negotiating a good resolution for you. What price you are looking for you will have to find on your own. It depends on the qualifications of the lawyer. The fines depend on the county you are arrested in.
