What is the sentencing range for identity theft?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)

It is a felony punishable by a maximum of five (5) years in prison. However, your sentencing range or sentencing guidelines will be determined on your past record. Without knowing your entire criminal history, it is impossible to tell what your range would be.

Will I be arrested since I missed my Drug Diversion per Penal Code 1000 court date?

If you fail to appear at any schedule court date, an arrest warrant is issued and a probation violation is charged. To handle a warrant, you must turn yourself in to the issuing court, with or without an attorney. You'll try to negotiate a recall of the warrant[s] and negotiate a plea bargain on the Failure to Appear charge. You'll try to negotiate bail reduction or OR release. While this isn't a 'capital case', you face potential jail and fines, so handle it right. Effective plea-bargaining, using whatever legal defenses, facts and sympathies there may be, could possibly keep you out of jail/prison, or at least dramatically reduce it, and may enable you to get your probation and programs reinstated. Unless you're competent to effectively represent yourself in court against a professional prosecutor trying to put you in jail, most people hire an attorney who can.
