Can I fight my DUI ticket if the officer did not fill out the BAC part?

Thomas J Tomko
Answered by attorney Thomas J Tomko (Unclaimed Profile)
Criminal Law lawyer at Thomas J. Tomko, Attorney at Law
Thank you for your inquiry It is not clear whether your offense is an OWI or an MIP. An OWI is Operating While Intoxicated. This is a driving offense which alleges that while you were operating or had the present ability to operate a motor vehicle, your ability to operate a motor vehicle was substantially and materially affected due to the use of alcohol. An MIP ticket alleges that you consumed intoxicating liquor while your were not yet 21 years old. They are quite different in penalty an approach. Either of these cases involves evidence of drinking. It is not tied to whether or not a particular form was completed. Each will depend upon the admissible evidence which is available to be introduced into evidence. Should you be interested in having your case reviewed, you should contact this office to make arrangements to meet and discuss the particulars of your case. I look forward to hearing from you.

Can I press charges against my soon to be ex husband for theft of my narcotics Oxycontin and Roxycodones with proof?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
If you have a prescription for those drugs, then yes you can. If you do not, then it will be hard to press charges without getting arrested yourself.

After 25 years of doing right, how can I be considered a criminal again and facing jail all over again?

I would strongly suggest you engage and an attorney to straighten out this matter. If when you are related in your factual situation is true this is an error and should be correctable. If, on the other hand, you missed some form of communication from your probation officer and failed to appear, you will have to deal with the fact that there is a warrant outstanding and you are currently listed as an absconder. Either way this is not going to go away until you actively seek to fix it, most preferably with the assistance of an attorney.
