If I forged several checks for small quantities what can I do not to end up in jail and pay that person back?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
You did not say if the cases have been filed yet. If not, there will be no arrest if you immediately pay the checks and there is no loss because, without a filing there is no criminal prosecution. If the bank notifies the police or your brother does you need legal representation. Each county has different rules as to how these cases are handled. The offense is completed when the forgery happened so if it is filed it can be prosecuted even if you have made restitution .

Is there anything we can do if she drops charges?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
She cannot drop charges - only a prosecutor can. She can tell the prosecutor she does not want to proceed. The family members can contact the prosecutor and explain why they think the charges should not be dropped.

What are the consequences for a violation of misdemeanor probation?

She can do up to the 90 days which were suspended. I'd have to know more about what court and who is the judge if it is in Alameda County to give you a better answer. She might be able to do the time on a bracelet.
