What happens when you get a second gun charge in a domestic violence scenario?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
He is in serious trouble. He will need a good criminal defense attorney to help him. And have him get rid of all guns and dangerous weapons...for your safety if nothing else. People get killed or seriously injured in situations like this every day. The DA and judge will take this very seriously. You should too!

If my case status goes from pending to closed, does that mean my probation is over?

Closed means the case is over. Where did you read closed? I would confirm with the probation officer.

Does the police have a right to search me and make me take a drug test?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
In a stop, they are only allowed to frisk you for weapons. To search you, they must have probable cause, a warrant or your consent. DO NOT CONSENT, no matter what. This is the same whether it is to find drugs on your person/property/stuff or in your blood (unless you are driving and they suspect DUI). Be polite and if they suggest you are hiding something, just say your attorney told you never to consent.
