Can I get my 1998 domestic misdemeanor dropped from my record?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
If you mean "expunged" when you say "dropped," yes and no. There is no such thing in California anymore as expunging one's record, meaning that the conviction is wiped away and no longer exists. That was changed about 20 years ago. Now, one can make what is called a "1203.4 motion," which in essence allows the charges to be dismissed. But it still shows on your criminal history, although it does show the dismissal under Penal Code section 1203.4. Yes, it will show up this way on a background check.

How do I restore my firearm right with a non violent misdemeanor?

Leonard D. Harden
Answered by attorney Leonard D. Harden (Unclaimed Profile)
Criminal Law lawyer at Harden Law Office
The first thing you should do is contact the lawyer that represented you on the federal misdemeanor. It seems to me if it was a non violent misdemeanor that you are improperly being denied the ability to purchase a firearm. The federal law banning purchases of firearms has a list of offenses which exclude folks. You may have been added to the list improperly, if you have a local gun shop that you can visit you should get proof of the underlying misdemeanor from the lawyer and then go fill out the Brady form truthfully and make sure you get any responses from the gun check people provided to you. If it is an error you will then be able to provide the court documents that support what type of offense is in you history. Good luck.

How many attorneys can you have on your murder case?

Answered by attorney Marshall S. Tauber

As many as the court will allow & he can afford. Do you remember the O.J. Simpson case? If not, look it up on Google.
