If my fiancé and I were caught shoplifting, were arrested and charged with a Class B Misdemeanor, what happens if I take the blame?

Do not take the blame until you have spoken with a criminal defense attorney. If you work out a deal to take the blame and in turn they dismiss the other person's case great, otherwise keep your mouth shut. Additionally, more than one person can be charged for the same crime, in the State of Texas. It is called the law of parties. Do yourself a favor and speak to an attorney before making rash decisions. Good luck.

First timecriminal mischeif felony case

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)

Unfortunately, being under the influence is not a defense to a criminal act in Texas. So, that argument isn't likely to gain you much traction with the DA's office. There may be other factors that could help your defense, but there's not enough information here to say whether that is true or not. Depending on your prior criminal history, if any, there may be options out there that can prevent this from becoming a final felony conviction on your record. Any attorney would need more information to tell you that definitively, though.

What can I do if I was issued a minor in consumption ticket without being tested or asked if i was drinking?

Answered by attorney Robert W. Eutsler (Unclaimed Profile)
Criminal Law lawyer at Eutsler Law Firm
You are correct in that factually, you are not guilty of the charged offense. It should have been minor in possession. However, the officer who wrote the ticket might give testimony that he smelled alcohol on your breath, which, if believed, would convict you. There is also a two year statute of limitations, so the case could be refiled correctly during that period. The ethnicity error only goes to the officer's credibility. It alone does not cause the case to be dismissed.
