A 13 year old lacks the legal capacity to consent to this sexual arrangement; period. The rape charge will probably not succeed because of the documented emails; however, he has committed Carnal Knowledge Of A Juvenile, and I think that carries a possible jail sentence of up to five years.

The fact that the person who "set him up" was under the influence is irrelevant. Form what you say, it is clear that you boyfriend has a history and has clearly not learned his lesson from his first go around. I would need to see the case file to see if there are any mitigating factors, but quite frankly, as this is a second time for the same type of offense and it was in a school zone, I do not see the judge as being at all sympathetic. I suspect that he is going to get the higher range of sentence.
