What can I do if I was accused of a crime that was found to be false?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Seal the record from public view. Forms at Colorado Supreme Court website request the accuser be charged with false reporting . Contact the DA sue the accuser, the police and the DA - but this gets more difficult unless the police and DA had good reason not to believe the accuser.

Where is a juvenile going to be held during a course of legal trial?

It depends. You say nothing about what the charge is, or whether the juvenile has a criminal history, or poses a risk to the community. If any of these are at issue, he could be held in juvenile detention, unless, he is close to adult age, or the crime is so serious, as to warrant the juvenile being charged as an adult. In this case, he could be held in adult detention. The court could also set a bond, that if met could allow release prior to trial. A defendant has the right to a trial within 90 days of his first court appearance. You really need to discuss these issues in detail with local counsel.

What can I do if I just found out I have a felony charge on my record for possession of marijuana with intent to distribute?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
If it shows as a charge or arrest, then you should be able to seal it. You can check your Colorado criminal record for less than $10 by going to Colorado Bureau of Investigation on-line. If it shows as a conviction, there is a bigger problem. But, since you never went to court etc, I think that is unlikely unless your friend posed as you in court - unlikely. It is not uncommon for police to forget a file for a few months, so be prepared to be arrested and know to say nothing about the facts, just say, "I want a lawyer." Keep saying it until you have one. I suspect this case is on-going.
