Yes. When the cops come out the ball is pretty much rolling. They make a report and then they call the district attorneys office. They ask the DA's if they'll accept charges. The DA's tell them what charges they'll accept, and then the accused person is arrested and taken to jail. At that point the only person who can dismiss it is the district attorney. There are ways the victim can help. But, the best thing to do is to work with his attorney to try and get the case resolved.

It's a real PIS in Houston, but other smaller counties are easier. I would recommend hiring a lawyer, but if you can't afford that, then go to the county clerk and they will help you file. Be prepared to jump through a lot of hoops to save the money of a lawyer.

Seeing as you probably don't know what reasonable suspicion or probable cause is to determine whether or not the police had it, you have to talk about the specifics of the case with an experienced criminal defense attorney. Taking the keys out of the ignition for the search of the trunk definitely is not something that can be done without a warrant or consent. Proving that is what happened is a different story.
