Can any probation officer show up at my house and not my particular officer?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)

What is unusual to me is that they would show up at night, not knocking first and asking for permission to enter (which you would have to grant if you gave a search and seizure waiver), and when you weren't home. While many search and seizure waivers that are given in probation situations allow for night searches, it almost never occurs in this manner. It would make sense to me if they were investigating a crime that was occurring at that time, or had a particular reason to search at that time, but then I would expect a police officer to be involved. In any event, you do not say that any evidence of a crime was seized, or crime observed, so there is nothing to seek to suppress by any unlawful entry. You should be cautious though; this might happen again.

Will a marijuana possession ticket change my insurance and can a diversion program prevent it from affecting my record?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)

This is not a Texas case as there is no ticket for marijuana. A conviction for marijuana will result in a revocation of your license and can affect you forever. Man up and talk to your dad. Time to take responsibility.
