When a person break probation is the ending result instant jail time?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
She can hire a lawyer to fight both cases. One case will be the motion to revoke her probation. The other will be the new law violation; likely an Assault-Bodily Injury. Depending upon where the case is pending, she may be put into a position where her attorney has to get prepared for a hearing on the motion to revoke first. If not, aggressively attacking the new case may help the motion to revoke go away. There's a lot that can be done on her behalf, if she was indeed defending herslelf in this situation.

How can I get a case dismissed if I have the person that called the cop and there was a misunderstanding to the situation and willing to testify .

Richard Keith Oliver

It depends on the County the case was filed in. If it's in a small County the DA's may contact the complainant, and based on that conversation, decide not to pursue it. If it's in a bigger County, like Harris County, all that will likely accomplish is having the DA's office transfer the case to the division that handles cases where the complainant "recants." (i.e. says it didn't happen or there was a misunderstanding, etc.). Be careful with having the person talk to the DA's though. If it's not said a particular way, you'll lose the advantage you currently have, and the DA's will be able to use that witness against you, whether they want to help them convict you or not. You need a good attorney to help guide you both through this situation, to be sure the resolution is in your favor.

How can one reduce the consequences of a shoplifting charge?

You should hire an attorney or see if you are qualified for appointed representation. Your jurisdiction may have a program or set of conditions that you can meet to have the case dismissed. An attorney can help you with that.
