I was arrested back in 2004 for Assault Causes Bodily Injury

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
Your lawyer has a great deal to work with. Depending on when you were indicted you may have a statute of limitations that applies to your situation. There is also a doctrine called laches that may result in dismissal. The facts dealing with how much effort was put into contacting you and efforts to bring the case to trial will be critical. Nine years is too long for a case to pend without disposition.

He absolutely could. It's up to your attorney, the DA, the Judge and him. Best to hire the best lawyer you can afford.

Can I be arrested for not giving someone their car back if I loaned them money?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Yes, you can be arrested for auto theft unless there was an agreement that you would keep the car until the money was returned (which you should have gotten in writing.) And, since the car is in the roommate's name, I can envision the roommate saying she wants her car back & you would definitely have to return it if she says it is hers because you have no agreement with her.
