What you are describing is a misd. violation of CA Penal Code 653.22. The code calls for a maximum term of 6 months in County Jail. With no priors it would not be uncommon, following a no contest plea, to be placed on probation and be ordered to stay away from the location where you were cited. You state you have no criminal record, yet you wish to appear and plead no contest. Why take such action and accept a criminal record? You have no duty to convict yourself. At the very least seek out counsel for a brief consultation on the relevant facts of the case.

Also depending on your age, the possibility of being tried as an adult and having convictions on your record. Pick another prank.

Is there a benefit to paying restitution by the set date like a waiver of an administrative fee by the probation department? If so, there may be nothing you can do. Civil cases take forever. However, you are entitled to an off-set in any restitution amount paid to the victims from the civil settlement. I recently had this issue and my client avoided the 10% administrative fees from the probation department by paying the full restitution within 30 days of sentencing. The insurance attorney withdrew the offer in the civil case and is making payment directly to the victim's family through the probation department. One other aspect of waiting for the civil matter to settle is that the amount of the civil settlement that actually goes to the victims may be reduced by their attorney's fees. By withdrawing the offer in the civil settlement and paying directly to the probation department, my client avoided having the victim's attorney fees reduce the amount he paid to them. I also stipulated with the prosecution on the record that the restitution payment was not to include attorney fees.
