What can I do if I was charged with possession but only cited?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
Cited means arrested without booking. You have a court date on the new criminal charges. In future. whenever threatened, arrested or charged with any crime, ?what can you do?? The best advice is to exercise the 5th Amendment RIGHT to SHUT UP and do NOT talk to police or ANYONE about the details of the case except through an attorney. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation. You already confessed and discussed it with police, all of which will be in their reports. Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict.

What are the outcomes of cases with a f496(a)?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)

I assume you are referring to Penal Code section 496(a) - possession of stolen property. I also assume the "f" in front of it refers to "felony". Yes, jail is a distinct possibility on this charge, depending on the facts and your prior record (if any). If this is a felony, you're looking at up to 3 years in custody (although that is just a maximum and not what you're likely to get), so you absolutely MUST have an attorney. I'd suggest looking for a good local criminal defense attorney that routinely practices in the court where your case will be heard. If you cannot afford an attorney (and you won't know until you meet a few and discuss the case and fees), then you can request the services of a public defender. If you financially qualify, the court will appoint an attorney to represent you.

Answered by attorney Joseph A Katz (Unclaimed Profile)

Yes, you can terminate probation early, via a Motion pursuant to Penal Code sections 1203.3 and 1203.4, and yes, you would stand a better chance of success if you hire an attorney.
