Can my felony charge be expunged?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
In Colorado, most convictions remain on your record forever. But, some minor drug felonies can be sealed from public view. If it was not a conviction, then it should be sealable.

Can they release my car from tow without me paying the ridiculous fee?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
CAN they release the car without payment? Sure. WILL they? No way. The tow yard is not interested in discussing your case, defenses or complaints, only in being paid for the tow and storage. That is their business. Follow their rules and retrieve the car. The longer you wait, the higher the charges. IF you could get the case dismissed entirely, with a court finding of factual innocence, you then might be able to file a damage claim with the city for your tow expenses. Dont count on that happening, since the arresting officer?s report is going to carefully explain why you were arrested on what should have been a ticket-able offense. I assume from the arrest that you are now charged with a misdemeanor crime, rather than the infraction this started as. In California, if convicted of any misdemeanor, you potentially face up to 12 months in jail, plus fines. You?ll get copies of all the Complaint charges, police reports, evidence and results when appearing for arraignment at the first court hearing. Police don't have to say or explain anything to you, before or after arrest, nor read your Miranda rights. Too much TV cop show 'reality' misleads the public about the real system. You would have an evidence suppression issue if prosecutors seek to introduce into evidence a statement or confession obtained after arrest without first advising you of Miranda rights. I can help you fight the criminal charges and get the best outcome possible. When arrested or charged with any crime, the proper questions are, can any evidence obtained be used against you, can you be convicted, and what can you do? Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal arguments, for evidence suppression or other motions, or for trial. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, diversion, program, charge reduction, or other decent outcome through plea bargain, or take it to trial if appropriate.

Can you be taken to court on a charge where the victim has died?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
If there is other evidence to support the charge, yes. But it will be very difficult for the prosecution to prove their case without the victim. Not necessarily impossible, but probably extremely difficult.
