Can you plead no contest for resisting arrest and get probation to get it dismissed?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
A plea of no contest does not result in a dismissal. To get it dismissed you must convince the court, D.A. or a jury that you are not guilty. If you can have the case reduced to a class C misdemeanor and get deferred probation it may be possible to get an expungement to erase the record.

Will the fines make me guilty and will it go on my record?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
DO NOT PLEAD GUILTY OR JUST PAY THE FINES FOR A THEFT. You should at least get deferred adjudication and have it not go on your record. Paying the fine could mean pleading guilty. Hire a competent attorney and do not plead guilty.

How long the civil order of protection is in effect and can it be cancelled in the future if the case is dropped?

Answered by attorney Matthew David Sharp
Criminal Law lawyer at The Law Office of Matthew D. Sharp
There are two types of protective orders in cases like this: 1. A magistrates order of emergency protection (or MOEP), which lasts for 60 days. In domestic violence cases these orders are commonly issued as a matter of course 2. A general protective order which is issued by a civil judge after a hearing. These last for two years, and you have to make an application first before the court can issue one.
