Can I defende myself in court against a misdemeanor?

You have the right to represent yourself in court but you will be held to rules of evidence so you will need to educate yourself both on rules of law and rules of evidence. You also have the right to a public defender if you cannot afford an attorney. there is no "one size fits all" defense you can just pick up on the internet. All criminal cases are fact-specific.

Will I go to jail for theft if I have a prior from 12 years ago?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
A prior is a prior. Records are forever. Yes, your record will be a factor. Other than that, the honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, testimony, priors history, etc. If it really is a second ?petty? theft without complicating factors, then if your attorney handles it well in plea bargaining, you probably face little if any jail time, but face fines, programs, probation, restitution, etc.

Your attorney works for you and like any employee, if you are not happy with him/her, you can fire your attorney and hire a new attorney.
