Can the police arrest me while unconscious? Sure. Winning a conviction is a different issue. You were arrested, but not charged, so you were released without being taken to court. Charges have now been filed. You get to defend them. You have legal and factual arguments to raise in your defense.

Some jurisdictions take longer than others to file DUIs and since this was an accident there was probably a blood test which generally takes longer to process. The accident may also be the basis for a felony charge depending on the surrounding facts.
