There will be a hearing before a judge and the prosecutor will be there. The judge will decide whether to revoke your husband's probation. If the judge revokes the probation, then a conviction for criminal mischief will be entered on your husband's record and he will have to complete the original sentence (jail time, fine, etc.) that he agreed to when he originally went to court and pleaded guilty and accepted the offer of SIS and probation.

To answer your original question, whether they are right or wrong, the D.A. can charge you with anything that they feel is supported by the evidence. Sometimes they're right and sometimes they're wrong. Your remaining questions requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated, such as were you represented by an attorney? Who was the witness against you and did they seem credible? Etc. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.
