Can I go to prison being a first time offender for 2nd degree Identity theft and Grand larceny?

Answered by attorney Warren S. Hecht
Criminal Law lawyer at Warren S. Hecht
It appears from your question that criminal proceedings have commenced. You could go to prison for these crimes even if you make restitution. You should have a criminal attorney representing you especially since these are serious crimes.

Answered by attorney Steven Fairlie
Criminal Law lawyer at Fairlie & Lippy, P.C.
If you can prove that you did not get notice you might have a chance, but there is a presumption that if notice was mailed to the address where you are licensed that you got notice, and it is then up to you to prove you did not get it.
