What is the punishment for first offense misdemeanor shoplifting?

Answered by attorney Kevin T. Ellmann
Criminal Law lawyer at Ellmann & Ellmann, P.C.
The punishments can be wide ranging depending upon where the case is pending, what your criminal history is, the circumstances of the crime, whether you have an attorney, etc. The bottom-line is that often, the most serious consequence is a permanent conviction record that you cannot (currently) under Colorado law ever seal! That is why it is so important to consult with a qualified attorney who can advise and assist you with this matter to try and do everything you can to avoid that permanent conviction that will cost you more in the future than any immediate fine, court cost, or even a few days in jail! I talk to people almost every day who have similar supposedly "minor" charges on the record from several year ago (when they were "young and dumb") and they cannot now find a job or rent an apartment because that "minor" conviction keeps popping up on a background check. In today's information age, there are no minor convictions!

What will happen and what can he do for unlawful use of drug paraphernalia charge?

Answered by attorney Lori A. Beck
Criminal Law lawyer at Beck Law Office, LLC
Your question is unclear. A drug paraphernilia charge is a petty offense in Colorado. But if I am reading your question correctly, it seems they caught him with other drugs. If so, his sentence depends on many factors, such as, his criminal history or the amount of drugs. He should consult an attorney.
