Am I being screwed by my lawyer?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
You need to get the transcript of all proceedings that took place and all paperwork associated with your case and have an experienced criminal appellate attorney review it as soon as possible. It sounds like there may be procedural or legal grounds to withdraw any pleas, sentencing agreements, or anything else that affected your case. Do this as quickly as possible because appeals are very time sensitive and have quick deadlines.

What can I do to keep the shoplifting off my record?

Answered by attorney Ezra N. Goldman
Criminal Law lawyer at Law Offices of Ezra N. Goldman P.C.
Well, you are under 18 so anything would go on your juvenile record, as opposed to your adult record. But this story is missing some pieces... no one but a judge could give you a fine? If you were arrested, or charged, you would know about it.

What happens if you test positive for drugs while on probation?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)

It will probably be a probation violation. Your PO will make a recommendation and the judge will make the decision. How long have you been on probation? They could extend or add to your probation, give you a reprimand, send you to jail. The worst thing that could happen is that you lose your HYTA status which is what you do not want to happen. Usually, most judges wouldn't pull your HYTA for a first time violation, unless it's something really serious. It would be a good idea to have a lawyer represent you however.
