Was it legal for cops to do a probation search even though I'm not on probation?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
A very interesting situation, and a very complicated one legally. My guess is that is will need to be litigated. These situations sink or swim on their facts. Don't be surprised if the police reports of the incident (and the cops' testimony should they testify) not corroborate either your story or what they said they were going to put in the reports. They will say exactly what they need to validate the search, probably that you consented to allow them to search your room (and/or that your friend did). They will try to establish what is called "ostensible authority," at the very least. You will probably be given a favorable offer by the DA initially, which you might be inclined to accept just to be done with the case. Should you reject it, you can then litigate the search/seizure issue. You will need a good lawyer to do this, so hopefully you will have one.

I want to make amends for a 25 year old crime; will I be arrested?

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)
Criminal Law lawyer at Law Office of Joe Dane
Yes, you could. I appreciate your faith and gestures, but from a legal standpoint, your best move is to do nothing, assuming there are no warrants for your arrest. If there were no charges filed, it is well past the statute of limitations and they couldn't file now, but if charges were filed in time, then the warrant may still be out for you. I'd suggest contacting a criminal defense attorney in the county where these would have been and seeing what your status is.

Can a non violent crime felon own a firearm with the convictions more than 10 years old?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
Probably. However, your right to possess a firearm is not automatic. You need to petition the court to have that right restored. Until you do so, you cannot legally possess a firearm.
