You can be charged with a state jail felony credit card abuse in four jurisidictions. In addition, you may be able to be charged in the county in which the complainant lives with burglary of a habitation - a second degree felony - because you entered with the complainant's effective consent (because the consent was obtained by fraud.)

If the theft was reported to the police and they are investigating and charge you with theft then it is up to the state and prosecution whether they move forward with charges. At that point it does not matter if the other party says they are not pressing charges since it has become a criminal matter. If the theft was never reported and you return the money then law enforcement may not find out.

You were lucky. The store didn't have you arrested so you will not have a criminal record and wont have to go to court. The letter you will get is a civil demand. NY law allows a store to seek five times the value of the goods stolen up to $500. However, I never have my clients pay this because I've never heard of a store actually filing a lawsuit to try and collect because it costs more to pursue the case than it is worth. Usually stores make someone sign a trespass notice while still at the store, which tells them they are banned from either that one store or the entire chain.
