Can a bench warrant be dismissed?

V. Iyer
Answered by attorney V. Iyer (Unclaimed Profile)
Criminal Law lawyer at Iyer Law Office, LLC
If he was in custody and can prove that then the Court issuing the warrant will dismiss the warrant and the warrant fee but he will have to face up to the charges that gave rise to requiring his appearance in Court. The burden is on your fiancee to prove why he could not appear and that the failure to appear was for good cause beyond his control or circumstances.

What do I do if I was not able to receive equal treatment?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
You can start by going to the Law Library and beginning your computer or hard cover research and searching for cases and authority for what you want to argue. That is what attorneys go to law school and continuing education to learn. Whether it will do you any good to argue what you think you know is a different issue. Law enforcement has discretion in their job. They can't stop everyone, and they don't have to. Good luck.

What happens if they charged me with trafficking in hydrophones and conspiracy and the misuse of a two device?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
It depends on the facts and you certainly do not know all the facts that they say exist. You do not have to sell in order to be charged with trafficking, you need a certain amount in your possession.
