New York does not expunge. In any event, if you plead guilty to CPCS in the 7th degree that is a crime and criminal records don't get sealed. The best you can do is seek a Certificate of Relief From Civil Disabilities.

The remedy for not being read your rights ("Mirandized") is that any admissions found to be involuntary that you may have made to the police cannot be used against you. It does not mean an automatic dismissal of the charges against you. The police know this so they don't bother Mirandizing you if they don't need your statements or a confession to prove your guilt.

Not sure who you've been speaking to, but the wait time for expungment (assuming you are eligible and have no other convictions) is 3 years, not 5. This means you became eligible in March of 2012.
