How do I plead on a shoplifting charge if I don't want to go to jail?

You should never plead guilty to a criminal charge until you have retained the services of an attorney to represent you, review the facts of your case and advise you of your options. If the charges are filed as a misdemeanor, your attorney can represent you in California without you being present in court. Also, shoplifting is a theft charge and a crime of moral turpitude which, depending on your immigration status, can make you inadmissible to return to the U.S., if convicted. What this means is that upon your return the U.S., you can be denied entry to the U.S. by CBP and returned to the country you were arriving from or you can be placed in removal proceedings where the gov't will attempt to deport you back to your home country. I strongly suggest that you contact an experienced criminal law attorney with knowledge of the immigration laws, or a separate immigration to work with your criminal attorney, for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze you case and advise you of your options.
