Chances are that they will charge you with possession with intent to sell. This is a felony charge. It is always better to have an attorney. You could possibly go to jail.

The prosecutor alone has the discretion on whether or not to pursue charges. They accept input from victims, but the decision is still theirs. She would have to appear in court and testify if ordered to otherwise she faces contempt of court charges. If she changes her story they could possibly charge her with filing a false police report.

Back then, a person was allowed to fully expunge a record. You seem to have done that. The law was changed in the mid-90s or so such that there is no longer a full expungement; the 'record' would show that the charge was reduced/dismissed, but the original conviction would always be on the person's record. Nowadays, with Livescan and other searches almost everything will show up on a records check. Since your record was fully expunged it should not "legally" appear, and you should be able to answer that you were not convicted of a crime. The government has become so very punitive in this regard and record everything (and it never goes away!), as you might be aware if you have been following the news lately relative to the government leaks and NSA situations; the government forces an individual to wear the scarlet letter for the rest of their lives, and the data they collect is mind-boggling. It is so very wrong and there is some legislation filtering through congress, at least in California, that would remedy this situation because so many people have made mistakes when they were young and are suffering because they cannot get jobs due to these searches and employer bias. Talk to your union and see if they can help you. Speak to an attorney about this and perhaps he/she can help you through it.
