Does a cop have to read me my rights if I was put in cuffs but I did not go to jail?

Is there anything I can do to avoid jail time or receive a record?

Answered by attorney Kevin T. Ellmann
Criminal Law lawyer at Ellmann & Ellmann, P.C.
It all kind of depends upon the amount of theft they are alleging. If the amount reaches a Felony level, the detective assigned to the case will almost certainly try to contact you (to supposedly "get your side of the story") before they proceed with a filing or request for warrant. You should not talk to the detective without Counsel and so it may be a good idea to find an attorney who will offer a free consultation and agree to be ready and available in case that call comes. Often times, the services of an attorney pre-filing can help avoid charges being filed at all, or assist with the issuance of a summons versus an arrest warrant.

Can the police raid my home based on an anonymous tip I am selling drugs?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
It sounds like you might have some good issues to challenge the search of the home, but much more information would be needed before any attorney could give you an informed opinion. You should hire a good local criminal defense lawyer, or at least contact one for a consultation.
