How do I help my fiance when hes been charged with aggravated assault with a deadly weapon and its a false report

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
The best thing you can do to help him is to encourage him to hire a good criminal defense attorney immediately. The smartest thing for him to do is to stop talking to law enforcement, or anyone else invovled with the case. Don't post about it online. Or anywhere else. If he's in jail, don't discuss the facts of the case-in other words what happened-with other inmates, or over the phone. Any given inmate could become an informer against him. And all phone calls are being recorded. He's been charged with a very serious felony offense. If it's a false report, as you say, a good attorney may be able to convince the DAs of that, and get the case dismissed. That's no easy chore, though. In my experience most DAs seem to be programmed to believe everyone is guilty. So, a good attorney will simply prepare the best defense available, and be prepared to fight, in the event the DAs refuse to throw up the white flag. Your attorney will be able to find out more information on the case. In all likelihood, the case is still being investigated, and they aren't going to release the information they have to another citizen.  Best of luck!

Should I turn myself in to the police?

default-avatar
Answered by attorney Edward Jerome Blum (Unclaimed Profile)
Criminal Law lawyer at Law Office of Edward J. Blum
DO NOT TALK TO THE POLICE! They do not want to help you. Their job is to gather evidence against you. They will use it to prosecute you for possession of heroin or worse. If you still think you want to talk to the police, don't do it. If you are not a lost six year old, the police are not your friends.

Can I charge my wife with theft if she sold something of mine without my permission?

Answered by attorney Ernest Lee
Criminal Law lawyer at Lee Law Group DUI Criminal Attorneys
Yes, if it wasn't community property, (in California), in which case of it was hers, so you'd have to charge her with stealing of the bass. Hey, find a good divorce lawyer also.
