I suspect law enforcement believes you were acting as an accomplice. If you are indigent, I suggest you screen for a public defender as soon as you are formally charged. Otherwise a lot of criminal defense lawyers will give a free initial consultation.

That depends on a lot of things. Petty theft with a prior can be treated as a felony. If you're still on probation for your first theft, you could have your probation revoked, which could result in jail time. You might also be accused of commercial burglary, which may result in prison time. It's impossible to guess what will happen without a lot more info. Sounds like you should invest in a lawyer.

What will happen? Prosecution for the felony crime currently charged, plus any other crimes the DA may chose to file, like conspiracy. The felony charges are possession for sale. His claim of defense is holding for a friend, thus admitting to possession and to conspiracy. IF one defendant takes all the blame, that still does not mean the other gets off. That is all part of plea bargaining by defense counsel, or trial strategy. In California, if convicted of any felony, you potentially face at least one or more years in prison, plus fines; on any misdemeanor, you potentially face up to 12 months in jail, plus fines. Multiple counts and charges will multiply your problems. The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, testimony, priors history, etc.Whenever threatened, arrested or charged with any crime, what can you do? No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense, other than the advice [if not already too late] is to exercise the 5th Amendment right to remain silent and do NOT talk to police or ANYONE about the details of the case except through an attorney. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation. He is facing felony counts with multiple years in prison if convicted. The only advice that is worth anything is to get legal counsel who knows how and what to do to best represent you, using whatever credible facts and evidence you may have for motions and defenses at trial, if necessary. Most cases are 'plea bargained' to avoid the risk of loss at trial and mandatory sentencing to the full term provided in the law upon conviction. The attorney's job is to get a good 'deal' you can live with, or prepare for trial. Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict.
