I had Mr. Kirby on retainer from the beginning of December to the end of January for child custody. The first red flag was when I booked the consultation and neither he, nor his assistants, performed a conflict-of-interest check. In January, Mr. Kirby removed himself from the case due to not only representing the opposing party in former cases, but also from knowing the opposing party personally. Mr. Kirby also disclosed the fact that the case would have to be continued to the opposing party before that information was ever offered to me. Mr. Kirby spoke a lot about his various connections with judges in Sampson County. Mr. Kirby empathized with the facts of my case, he drew comparison to a father not being able to see his child despite having substantial evidence of being an active and competent parent. I'm sure Mr. Kirby is an honest man, however, the events that transpired with my case are a cause for concern, especially when a parent was unjustifiably alienated from their child.
