Superb performance in our commercial constitutional and administrative law series of suits styled Pearson versus Shalala. These suits forced the FDA to obey the First Amendment and allow truthful non-misleading statements regarding the health effects of dietary supplements. Pearson v. Shalala established qualified health claims and structure-function claims, laying the foundation for the modern multi-billion dollar per year dietary supplement and health food industry.
