About Schwartz Injury Law - Nursing Home Abuse & Neglect Group

Nursing Home Abuse and Neglect Abuse Attorneys Serving the State Of Illinois

At Schwartz Injury Law, we have an experienced team dedicated to representing victims of nursing home abuse and neglect. Our attorneys have in-depth knowledge of this area of the law, and we have the skills, dedication, and resources to prevail against even the most well-funded adversaries. Aging demographics, inadequate staffing, and a trend toward industry consolidation have created a culture of substandard care in Illinois nursing facilities. There is no excuse for our honored elders to be mistreated in a facility they and their families entrusted to look after their day-to-day needs. Our mission is to provide a strong voice for the most vulnerable in our society, so victims can receive the just compensation they deserve, and those responsible for this egregious conduct are held fully accountable.

Practice Area Overview

We handle all types of nursing home neglect and abuse cases, including but not limited to:

• Life-Threatening Injuries: Staffing shortages and related problems often result in the inadequate supervision of nursing facility residents. This can lead to serious incidents such as falls, fractures, burns, choking, and other severe injuries. Malnutrition and dehydration are other factors that weaken patients and contribute to these types of injuries.

• Lack of Medical Care: Many elderly nursing home residents are weak and vulnerable to illness. When the staff does not recognize the obvious need for medical care, conditions such as bed sores, sepsis, and infections can develop and quickly worsen. Incompetent care is another major problem, leading to medication errors, breathing tube injuries, and other hazards.

• Elder Abuse: Because nursing homes tend to be short-staffed, they often have difficulty finding quality employees. This results in more residents being physically or sexually abused by staff. Alzheimer's and dementia patients are particularly vulnerable to abuse because perpetrators believe that they will not remember what happened.

• Wrongful Death: The rise in nursing home negligence and abuse in recent years has resulted in greater numbers of preventable deaths. When wrongful deaths occur in nursing homes, the victims' loved ones deserve to be compensated.

• Assisted Living and Rehab Facility Lawsuits: The Illinois Nursing Home Care Act does not apply to most assisted living and rehab facilities in the state. This, however, does not mean that you cannot bring a lawsuit against one of these facilities for neglect or abuse. We know which laws apply to these facilities, and what is necessary to bring a successful legal action.
