Daniel joined MSK in February 2017 after twenty-one years of diverse commercial litigation practice with two prominent Vermont firms. He represents individuals, businesses and government entities in all aspects of the adversarial process, including pre-trial, trial and appellate proceedings, mediation and arbitration.

Daniel brings a wealth of professional experience, creativity, street smarts and common sense to every matter. He aims to resolve disputes amicably where possible, and he is prepared to litigate those matters that cannot be settled.

Upon graduating from NYU Law School in 1990, Daniel joined Proskauer, one of New York City’s oldest and largest law firms. At Proskauer, Daniel gained experience in general commercial, labor and employment, antitrust, securities, international, bankruptcy, banking, estates, communications and products liability litigation.

Daniel returned to Vermont in 1996 and has maintained an active commercial litigation practice ever since.

In addition to his extensive commercial litigation background, Daniel has successfully litigated precedent-setting Native American law cases.

Representative Engagements

- Represented a state government entity against its insurer, claiming estoppel to deny insurance coverage and negligent misrepresentation regarding the existence of coverage.

- Represented abutters opposing a proposed multi-unit housing project that requires the use of transferable development rights for its intended excess density.

- Represented corporate and individual defendants in a trespass/nuisance/boundary dispute litigation concerning neighboring parcels on a Native American reservation.

- Represented an automobile dealership in a dispute with a vehicle manufacturer concerning the geographic placement of a proposed competing dealership.

- Represented an automobile dealership in a dispute with a vehicle manufacturer’s regional distributor concerning the dealership agreement’s renewal and upgrades to the dealership facility.

- Represented a federally recognized Native American tribe, its Tribal Police Department and its Board of Police Commissioners in a whistleblower lawsuit filed by a former Tribal Police officer.

- Represented numerous residential condominium owners who sued the developers of a luxury condominium hotel for violations of the federal Interstate Land Sales Full Disclosure Act of 1968, the Vermont Consumer Fraud Act, the Vermont Common Interest Ownership Act and Vermont common law.
