I am a tax professional that specializes in cross border tax work. I recently had a common client with a Hodgson's attorney. The client is a Cdn with US business interests. The Hodgson attorney's efforts were solely to try to avoid US estate tax, and put the client's investment in a corporation. If the client's US investment appreciated (the attorney's concern) and the investment was in a company (as recommended by Hodgson) the client would pay around 60% income tax when the investment was sold in the company versus a 40% estate tax exposure if the investment was held personally. The attorney repeatedly tried to avoid estate tax with no consideration of larger income tax issues. This is the 2nd time an attorney from Hodgson gave poor advice to a client of mine. The first time, after being challenged, the attorney acknowledged the advice she provided was tainted, but wouldn't change the advice. She agreed with the idea if the idea was theirs that she would recommend it. Poor response.
