We retained Rory Weiner to help us in a property line dispute. Our surveyor screwed up the 7 surveys he took. Weiner settled us out of court. We moved the fence. But, our surveyor & Weiner are friends, Weiner wouldn't specify where exactly to put the fence since it would contradict his friend's statements. He spoke generalities. He fired us & we went to another attorney who gave us specifics, we moved the fence again & we ended up back in court without an attorney & the case was dismissed.
Mr. Weiner has violated the following rules of professional conduct: • Rule 4-1.1 (Competence) • Rule 4-1.4 (Communication) • Rule 4-1.7 (Conflict of Interest) • Rule 4-8.4(c) (Dishonesty, Fraud, Deceit) Mr. Weiner had the balls to try to invocate “confidentiality” in a particular case violating and misusing of Rule 4-1.6. It was used not to protect his alleged client, but to conceal his own misconduct and fraudulent transfer of someone’s property interest. He should reasonably know he cannot lawfully extend this actions that involve third-party property rights or fraudulent documents. He should be disbarred.
None of the above, he’s unethical, should be dis-barred and has no business running a title agency as he acted and conspired with a client’s family member as the title agent for the property sale through his title company he owns, after placing the home in a trust for no reason other than to help a do owner steal the home, he engaged in criminal behavior by: Charging for a title search that was never performed. Failed to disclose his dual role as both the attorney setting up the trust (that was altered after the fact) and the title agent in which he benefited financially from the transaction. He’s not only negligent, which is the failure to use ordinary care, he participated and encouraged criminal acts.
