About Mark Cohen

Mr. Cohen has 42 years of experience as a lawyer. Mr. Cohen grew up in Colorado and earned at B.A. in Economics at Whitman College in Walla Walla, Washington. He earned his law degree at the University of Colorado School of Law in Boulder in 1983. He earned a Masters in Law (LL.M.) degree in Agricultural and Food Law from the University of Arkansas School of Law, where he also taught as an adjunct faculty member. He was selected as a Super Lawyer in 2021-2025.

Mr. Cohen's diverse legal career includes service as an Air Force Judge Advocate, service as a Special Assistant U.S. Attorney, private practice in Nebraska, seven years as a prosecutor, service on the Executive Board of the Colorado Municipal League, several years as a Municipal Judge for Boulder, nine years as Municipal Judge for Lochbuie, private practice in Colorado, and service for six years on the Board of Editors of The Colorado Lawyer (Chairperson for 2012-2013). He served as a Legal Advisor to TermScout, a Denver-based legal-tech company that helps people and businesses understand the contracts and privacy policies they agree to so they can make better decisions about what terms to accept. A frequent speaker, Mr. Cohen promotes the use of plain English over Legalese. His article, How to Draft a Bad Contract, has been republished many times and is used in several law schools.

An accomplished writer, Mr. Cohen authored six articles for the Am.Jur. Proof of Facts series, including one on piercing the corporate veil. Mr. Cohen's first mystery, The Fractal Murders , was published by Time/Warner and became a Book Sense® Top Ten Mystery selection. His second mystery, Bluetick Revenge, won praise from authors that included Kinky Friedman. He won second place in the 2004 SEAK National Legal Fiction Writing Competition. One of his interests is the use of Plain English rather than legal jargon. He studied logic and philosophy at the graduate level and is a member of the Institute for General Semantics. He writes a regular column for the Nederland Mountain-Ear.

Mr. Cohen's skill in translating documents from "Legalese" into plain English is well known, and other Colorado lawyers have hired him to review and edit briefs and other legal documents. Mr. Cohen speaks frequently on contract drafting, plain English, real estate law and litigation and piercing the corporate veil. He gave a presentation to the Colorado Bar Association on issues unique to mountain real estate and in 2022 was invited to speak on the law of easements at the Rocky Mountain Surveyors Summit. He has presented CLE classes on contract drafting and piercing the corporate veil for Strafford Publications, Rossdale CLE, MESA CLE, and LawPracticeCLE, among others.

Mr. Cohen earned a black belt in Shudokan karate and taught karate. In 2022, Colorado Governor Jared Polis appointed him to serve on the Colorado Combative Sports Commission, formerly the Colorado Boxing Commission. He served on the Commission for roughly three years.

We retained Mark for a fence dispute in Boulder county, which we were very worried about after calling 5-6 other survey companies and lawyers. Once we talked to Mark, it became very clear that the plaintifs had no serious cases. Mark looked into it, wrote a letter on our behalf, and we never heard from the plaintifs lawyer ever again. It pays to hire a lawyer who knows his law!!! Thank you Mark

We hired Mark to review and start the litigation process in regard to a very complicated commercial real estate transaction. We have also had him review several contracts with construction professionals. Mark helped me navigate my options and legal rights with regard to a property boundary issue. He also drafted and filed a permissive easement on my behalf to allow my neighbor to continue landscaping an area of land that I found out was actually my property after having my property surveyed (thus preventing the neighbor from making any future claims of ownership). I recommend his services without reservation.

Our Colorado mountain neighbors threatened to restrict us from accessing our properties across a strip of their land adjacent to the road. Thanks to Mark, we won on every point without concession. We needed an attorney who could use his knowledge of easement law to defend our rights and file the easements with Boulder County. We needed a strong-willed, smart attorney who could build an unequivocal case in our favor and prevail in a hostile negotiation. During our free consultation, Mark proved he had insights and experience we did not find in other attorneys. Mark trusted us to gather facts to expedite the process and limit our expenses. Mark was transparent about his fees. Mark communicated effectively with the other attorney. He listened to us and never deviated from our demands. Mark was firm, insisting that he rather than the other attorney would draft the settlement agreement and easement documents. I would hire Mark for any property dispute related to county easement laws.

Mark is an excellent business attorney and knows how to protect you in commercial leases. He listens to your concerns and is a bulldog with people trying to push you around. My condo community's HOA board and management company were both unresponsive to the point that we had numerous safety violations that threatened the lives of our most vulnerable residents (older, one in a wheelchair, families with small children). But in the contract the HOA signed, managment claimed to have no liability whatsoever for any of their actions. Mark wrote a letter to both the management company and the HOA board that demonstrated the former's liability and the latter's negligence in failing to repair unsafe conditions. This lit a fire under both entities, with the result that we are all making the community safer for everyone. We're also discovering that management is indeed liable but that we don't need their very poor services. It's a great relief to know that our most vulnerable residents can feel much more secure in their homes.
